This is the labor certification process administered by the US Department of Labor, filed on Form ETA-9089. According to U.S. Department of Labor (DOL), the purpose of this step is to test the labor market: to prove that no qualified, available and suitable US worker exists for the proposed position.

In other words, this is a test designed to protect domestic workers. Only after passing this step is the employer permitted to file a petition for the foreign candidate. As such, it is the first gateway of the entire application.

Mandatory test recruitment process

To obtain certification, the employer must carry out a test recruitment process. This includes posting job advertisements according to specific requirements and keeping them open for a set period. The purpose is to create a genuine opportunity for US workers to apply.

If no suitable US candidate is found, the employer may then proceed. The entire process must be carefully documented, as it may be audited later. Errors at this stage are among the leading causes of applications being denied or delayed.

Processing time and influencing factors

Labor certification processing time depends on the caseload at the Department of Labor and can take many months. This is often one of the longest stages of the entire EB-3 process.

Before this step, there is also a prevailing wage determination stage, which takes its own separate time. Because of this, you should understand from the outset that most of an application’s waiting time lies in the stages handled by government agencies, not deliberate delay by the employer.

Why this step helps identify genuine opportunities

A side benefit of understanding the PERM step is the ability to spot genuine opportunities from fraudulent ones. A “ghost” employer with no real business operations would find it very difficult to legitimately pass this recruitment and testing process.
